Specifically, they aim to require the court, when hearing cases en banc, to have 15 justices and to enhance the voting threshold chamber to 2\/3. These two measures, although their legitimacy is debatable abstractly, pose a concrete threat to Taiwan&#8217;s constitutional institution because the LY does not actively exercise its confirmation power on the 8 newly nominated Justice candidates. The proposed amendment would freeze the competence of the remaining 7 Justices in the court.<\/p>\n<p>\u96d6\u7136\u9019\u500b\u8349\u6848\u9084\u5728\u8a55\u8b70\u4e2d\uff0c\u4e00\u4efd\u5f9e\u7279\u5b9a\u7acb\u6cd5\u59d4\u54e1\u6d29\u9732\u7684\u6587\u4ef6\u6307\u51fa\uff0c\u67d0\u4e9b\u4eba\u60f3\u8981\u8b93\u9019\u90e8\u6cd5\u5f8b\u5373\u523b\u751f\u6548\uff0c\u4e26\u4e14\u907f\u514d\u61b2\u6cd5\u6cd5\u5ead\u80fd\u5920\u8655\u7406\u9019\u90e8\u6cd5\u5f8b\u7684\u5408\u61b2\u6027\u3002<\/p>\n<p>\u6211\u8207\u5e7e\u4f4d\u670b\u53cb\uff0c\u4e00\u8d77\u5beb\u4e86\u4e00\u4efd <a href=\"https:\/\/www.upmedia.mg\/news_info.php?Type=2&amp;SerialNo=217572\">\u6295\u66f8<\/a> \u8aaa\u660e\u61c9\u8a72\u5982\u4f55\u5c07\u9019\u500b\u6848\u5b50\u9001\u5165\u61b2\u6cd5\u6cd5\u5ead\u3002\u6211\u5011\u4e3b\u5f35\uff1a\u4eba\u6c11\u3001\u5c11\u6578\u7acb\u59d4\u3001\u5404\u7d1a\u6cd5\u9662\u6cd5\u5b98\u53ca\u53f8\u6cd5\u9662\uff0c\u90fd\u53ef\u4ee5\u3001\u4e5f\u61c9\u8a72\u5728\u61b2\u6cd5\u8a34\u8a1f\u6cd5\u4fee\u6cd5\u901a\u904e\u4e4b\u5f8c\uff0c\u7acb\u5373\u8072\u8acb\u6cd5\u898f\u7bc4\u61b2\u6cd5\u5be9\u67e5\u53ca\u66ab\u6642\u8655\u5206\uff0c\u5728\u9019\u9805\u4e0d\u7576\u7684\u4fee\u6cd5\u7671\u7613\u61b2\u6cd5\u6cd5\u5ead\u4e4b\u524d\uff0c\u5c31\u51cd\u7d50\u3001\u4e26\u6700\u7d42\u5ee2\u68c4\u5b83\u7684\u6548\u529b\u3002<\/p>\n<p>\u9019\u7bc7\u6587\u7ae0\u4e3b\u8981\u8655\u7406\u7684\u4e00\u500b\u554f\u984c\u662f\uff0c\u5c11\u6578\u7acb\u59d4\u5728\u6cd5\u6848\u300c\u9084\u672a\u6b63\u5f0f\u751f\u6548\u524d\u300d\uff0c\u5230\u5e95\u80fd\u4e0d\u80fd\u63d0\u51fa\u8072\u8acb\uff1f\u6211\u5011\u5f9e\u6587\u7fa9\u89e3\u91cb\u3001\u6b77\u53f2\u89e3\u91cb\u53ca\u76ee\u7684\u89e3\u91cb\u63d0\u51fa\u76f8\u61c9\u7684\u8ad6\u8b49\uff0c\u4e26\u4e3b\u5f35\u6709\u9650\u5b9a\u7684\u80af\u5b9a\u898b\u89e3\u3002<\/p>\n<p>\u6587\u7ae0\u4e2d\u6c92\u6709\u8655\u7406\u7684\u90e8\u5206\uff0c\u4e3b\u8981\u662f\u4eba\u4e8b\u722d\u8b70\u672c\u8eab\u80fd\u4e0d\u80fd\u5920\u91cb\u61b2\u3002\u6211\u500b\u4eba\u662f\u63a1\u53d6\u5426\u5b9a\u898b\u89e3\uff0c\u56e0\u70ba\u61b2\u6cd5\u8a34\u8a1f\u6cd5\u5df2\u7d93\u6c92\u6709\u61b2\u6cd5\u7591\u7fa9\u89e3\u91cb\u7684\u8a34\u8a1f\u985e\u578b\u3002\u61b2\u6cd5\u6cd5\u5ead\u4e0d\u592a\u53ef\u80fd\u6253\u81ea\u5df1\u7684\u81c9\u53c8\u7a62\u571f\u8f49\u751f\u81ea\u5df1\u62ff\u6389\u7684\u8a34\u8a1f\u985e\u578b\u3002\u800c\u4e14\uff0c\u904e\u53bb\u91cb\u5b57\u7b2c632\u865f\u89e3\u91cb\uff0c\u505a\u6210\u5f8c\u9084\u662f\u6c92\u6709\u4eba\u8981\u807d\u5927\u6cd5\u5b98\u7684\u8a71\u3002\u6240\u4ee5\uff0c\u5927\u6cd5\u5b98\u57fa\u65bc\u9019\u7a2e\u5403\u529b\u4e0d\u8a0e\u597d\u7684\u7d50\u679c\uff0c\u4e0d\u592a\u53ef\u80fd\u518d\u6b21\u8655\u7406\u9019\u500b\u722d\u8b70\u3002<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Recently, the Taiwan Constitutional Court has been facing the threat of court curbing from the majority of congressmen in the Legislative Yuan (LY), composed of the Kuomintang (KMT) and the Taiwan People&#8217;s Party (TPP).
