{"id":183,"date":"2025-07-30T16:36:18","date_gmt":"2025-07-30T16:36:18","guid":{"rendered":"https:\/\/yinnching.lu\/?p=183"},"modified":"2025-07-30T21:08:58","modified_gmt":"2025-07-30T21:08:58","slug":"jul-30-2025-update-taiwan-constitutional-court","status":"publish","type":"post","link":"https:\/\/yinnching.lu\/zh\/2025\/07\/30\/jul-30-2025-update-taiwan-constitutional-court\/","title":{"rendered":"2025\u5e747\u670830\u65e5\u2014\u2014\u61b2\u6cd5\u6cd5\u5ead\u66f4\u65b0"},"content":{"rendered":"<p class=\"whitespace-normal break-words\">\u6211\u6642\u4e0d\u6642\u5730\u6703\u66f4\u65b0\u61b2\u6cd5\u6cd5\u5ead\u7684\u8fd1\u6cc1\u3002\u5167\u5bb9\u5305\u62ec\u4e0d\u9650\u65bc\u61b2\u6cd5\u6cd5\u5ead\u7684\u6700\u65b0\u9032\u5c55\uff0c\u4ee5\u53ca\u53f0\u7063\u5b78\u8005\u7684\u8a55\u8ad6\u3002\u5982\u679c\u4f60\u559c\u6b61\u9019\u4e9b\u5167\u5bb9\uff0c\u6b61\u8fce\u5206\u4eab\uff01<\/p>\n<p class=\"whitespace-normal break-words\">\u6211\u597d\u4e45\u6c92\u6709\u66f4\u65b0\u4e86\u3002\u6c92\u6709\u4ec0\u9ebc\u85c9\u53e3\uff0c\u5c31\u662f\u6211\u7684\u6642\u9593\u7ba1\u7406\u6700\u8fd1\u51fa\u4e86\u4e9b\u554f\u984c\u3002\u4f46\u4e00\u500b\u91cd\u5927\u7684\u539f\u56e0\u5c31\u662f\u61b2\u6cd5\u6cd5\u5ead\u771f\u7684\u88ab\u7671\u7613\u4e86\uff0c\u6240\u4ee5\u6c92\u4ec0\u9ebc\u771f\u7684\u91cd\u8981\u7684\u65b0\u767c\u5c55\u3002<\/p>\n<p class=\"whitespace-normal break-words\">\u672c\u7bc7\u8cbc\u6587\u5c07\u8457\u91cd\u9019\u534a\u5e74\u4f86\uff0c\u61b2\u6cd5\u6cd5\u5ead\u7684\u52d5\u5411\uff0c\u5c24\u5176\u662f\u91dd\u5c0d\u61b2\u6cd5\u8a34\u8a1f\u6cd5\u7684\u884c\u70ba\u3002\u6211\u81ea\u5df1\u89ba\u5f97\u662f...\u76f8\u7576\u6709\u8da3\u7684\u3002<\/p>\n<p>***<\/p>\n<h3 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">The TCC&#8217;s Puzzling Moves<\/h3>\n<h4 class=\"text-lg font-bold text-text-100 mt-1 -mb-1.5\">February 10, 2025: Shutting Out the Little Guy<\/h4>\n<p class=\"whitespace-normal break-words\">The TCC&#8217;s second chamber <a href=\"https:\/\/cons.judicial.gov.tw\/docdata.aspx?fid=5511&amp;id=354839\">\u4e0d\u53d7\u7406<\/a> a petition challenging the constitutionality of the CPAA amendment. The case was brought by a citizen petitioner\u2014actually an alcohol company\u2014arguing that the amendment shut down the court, preventing timely resolution of their previous case about compelled speech on wine labels violating freedom of speech. Their original petition had been granted certiorari back on June 2, 2023, and it&#8217;s still sitting in the docket.<\/p>\n<p class=\"whitespace-normal break-words\">The chamber dismissed the case with three reasons that are, frankly, quite unreasonable:<\/p>\n<ol class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-decimal space-y-1.5 pl-7\">\n<li class=\"whitespace-normal break-words\">The CPAA isn&#8217;t the law applied in lower courts<\/li>\n<li class=\"whitespace-normal break-words\">The petitioner didn&#8217;t exhaust all legal remedies against the amendment<\/li>\n<li class=\"whitespace-normal break-words\">The petition was filed too late\u2014beyond the required 6-month deadline after receiving the lower court decision<\/li>\n<\/ol>\n<p class=\"whitespace-normal break-words\">This strict application of the law is completely different from how they&#8217;ve applied it before. What this decision really conveys is that this type of case can never be brought by ordinary people. Since constitutional procedural acts are never within the jurisdiction of regular courts, it&#8217;s completely unrealistic to fulfill the requirements the TCC is demanding.<\/p>\n<h4 class=\"text-lg font-bold text-text-100 mt-1 -mb-1.5\">May 14, 2025: But Politicians? Sure, Come On In<\/h4>\n<p class=\"whitespace-normal break-words\">Out of surprise, the TCC <a href=\"https:\/\/cons.judicial.gov.tw\/docdata.aspx?fid=52&amp;id=355485\">decided<\/a> to hear the constitutionality of the CPAA on May 14, 2025. This case, different from the dismissed petition, was filed by Democratic Progressive Party legislators in parliament. The decision came after an <a href=\"https:\/\/cons.judicial.gov.tw\/docdata.aspx?fid=77&amp;id=355489\">informal meeting<\/a> between justices, petitioners, and experts on April 18. Unlike oral arguments, informal meetings are a procedural device for the TCC to gather necessary information.<\/p>\n<p class=\"whitespace-normal break-words\">However, until now, the TCC hasn&#8217;t done anything after deciding to hear the case.<\/p>\n<h4 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">Why Politicizes the Court?<\/h4>\n<p class=\"whitespace-normal break-words\">In my opinion, the TCC&#8217;s decision-making is quite unwise if they really want to hear this case. By hearing it as a conflict between political parties instead of on the first occasion with the citizen petition, the TCC has stepped into the deep waters of political conflict. Neither a constitutional nor unconstitutional decision can help the court escape criticism\u2014they&#8217;ll be called a party-manipulated puppet either way.<\/p>\n<p class=\"whitespace-normal break-words\">The choice the court needs to make isn&#8217;t just about legal acquiescence or self-protection. They need to consider public criticism too.<\/p>\n<p class=\"whitespace-normal break-words\">Similar to other apex courts worldwide, &#8220;the judiciary can impose constitutional constraints on powerful political actors only if these actors support the judiciary\u2014either because the public does or the politicians themselves do (<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=5325857\">Bradley &amp; Siegel, 2025<\/a>).&#8221; The current parliamentary majority is obviously not allied with the TCC, and the public, after the failed recall efforts, isn&#8217;t either. This is why I think intervening in this case through political conflict is unwise. No matter what the legal arguments are, it looks like the TCC need to chose a camp to join. It&#8217;s bad for judicial trust and even worse for restoring the TCC&#8217;s authority.<\/p>\n<p>***<\/p>\n<h3>Recent Political Drama<\/h3>\n<h4 class=\"text-lg font-bold text-text-100 mt-1 -mb-1.5\">July 25: Nobody Gets Confirmed<\/h4>\n<p class=\"whitespace-normal break-words\">Parliament exercised their confirmation power on new TCC justice candidates nominated by President Lai Ching-te in the second round. None was confirmed as the first time. The KMT and TPP alliance didn&#8217;t confirm any justice candidates, but surprisingly, the DPP didn&#8217;t confirm all the justices either. Two candidates\u2014law professors Chan Chen-jung and Chen Tzu-yang\u2014received only 26 out of 56 DPP votes.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-186 aligncenter\" src=\"https:\/\/yinnching.lu\/wp-content\/uploads\/2025\/07\/vote-225x300.png\" alt=\"\" width=\"225\" height=\"300\" srcset=\"https:\/\/yinnching.lu\/wp-content\/uploads\/2025\/07\/vote-225x300.png 225w, https:\/\/yinnching.lu\/wp-content\/uploads\/2025\/07\/vote-9x12.png 9w, https:\/\/yinnching.lu\/wp-content\/uploads\/2025\/07\/vote.png 721w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/p>\n<p class=\"whitespace-normal break-words\">While there&#8217;s no official explanation, my reading is that most legislators still see justice candidates as their potential promoters in the court. For example, these two professors revealed more reserved views toward policies promoted by the KMT and TPP alliance.<\/p>\n<h4 class=\"text-lg font-bold text-text-100 mt-1 -mb-1.5\">July 26: The Great Recall That Wasn&#8217;t<\/h4>\n<p class=\"whitespace-normal break-words\">The citizen-initiated, DPP-supported &#8220;great recall&#8221; failed to unseat any legislators in parliament. If I remember correctly, this recall was initiated by the Economic Democracy Union, an NGO established during the 2014 Sunflower Student Movement. They came up with this political strategy after several legal strategies failed\u2014like requiring the president to unpublish the law or dissolve parliament.<\/p>\n<p class=\"whitespace-normal break-words\">The DPP didn&#8217;t initiate the great recall but joined the movement after most recall requirements were fulfilled. Within the recall movement, it was <a href=\"https:\/\/verfassungsblog.de\/taiwan-recall-democracy\/\">framed<\/a> as the only way to secure Taiwan by unseating pro-China legislators. However, this didn&#8217;t persuade most voters.<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>I occasionally share updates and trivia from the court, along with public comments from Taiwanese legal scholars on cases and court business.
